The claims process

A clear first step. A process you can understand.

Every claim is different. Here is what the main stages can involve, from the first conversation to a possible resolution.

01 / Tell the team what happened

Explain the incident or treatment, when it happened and the effect on your life. You can also raise any immediate concerns about work, care needs or a deadline. The team can assess whether the matter may be suitable for further investigation.

02 / Understand your options and funding

If the firm may be able to assist, it will explain the next steps, any checks required and possible funding arrangements. Ask about fees, deductions, insurance and circumstances in which costs could become payable. You decide whether to proceed.

03 / Gather evidence and investigate

The investigation may include records, witness accounts, photographs and independent expert evidence. The team considers both who may be responsible and what injury or loss their actions caused. Medical negligence claims usually require specialist medical evidence.

04 / Assess the impact and discuss resolution

The claim may include the injury and reasonable losses caused by it, supported by evidence. Settlement offers need careful consideration, including the expected recovery and any future needs. Court proceedings may be required if the matter cannot otherwise be resolved.

05 / Reach an outcome

If a claim succeeds, any settlement, deductions and practical next steps should be explained. There is no guaranteed result or fixed completion time. Complexity, disputed responsibility, evidence and recovery can all affect how long a matter takes.

Do not wait for every document

Start with what you know. Seeking advice promptly can help preserve evidence and identify a deadline. Sending an enquiry, reporting an accident or making a complaint does not itself start court proceedings.
