What the phrase means
A conditional fee agreement sets out when a solicitor’s fees are payable. The phrase “No Win, No Fee” is a starting point for a conversation about funding; the agreement is what determines your obligations. Eligibility is assessed individually.
If your claim succeeds
A success fee and other agreed charges or insurance premiums may be deducted from compensation. The calculation and any applicable limits should be explained clearly before you sign. Do not assume that every claim or funding arrangement has the same deductions.
If your claim does not succeed
Your position depends on the agreement and any insurance. Ask about disbursements, the other party’s costs, cancellation, failure to co-operate and other exceptions. The team should explain what protection is available and what risks remain.
Questions worth asking
- What would I pay if the claim succeeds?
- What could I owe if it is unsuccessful?
- Is insurance required and when is the premium payable?
- What happens if I cancel or change solicitor?
- Could existing insurance or another funding option cover the case?
